Accident (Section 80 IPC)
Introduction
Accident is a general defence in criminal law. It applies when harm is caused without intention or knowledge.
Section 80 of the Indian Penal Code protects acts which are done lawfully and carefully, but still result in harm due to an unexpected event.
Meaning / Definition
Accident refers to an act where harm is caused without criminal intention (mens rea) or knowledge, and without any fault.
Under Section 80 IPC, an act is not an offence if:
- It is done without criminal intention or knowledge
- It is a lawful act
- It is done in a lawful manner
- It is done by lawful means
- It is done with proper care and caution
Accident means something that happens unexpectedly and without human fault.

Essential Conditions for Defence of Accident
For the defence to apply, all conditions must be satisfied:
Absence of Mens Rea (No Guilty Mind)
- The act must be done without intention or knowledge of causing harm
Lawful Act
- The act itself must be legal
Lawful Manner and Means
- The act must be performed properly and legally
Proper Care and Caution
- The person must act as a reasonable person would act
- Not the highest care, but reasonable care is required

- If the act is unlawful
- If the act is done carelessly or negligently
- If proper caution is not taken
