Attempt and Abetment to Suicide (Sections 309 & 306 IPC)
Introduction
Suicide refers to intentionally ending one’s own life.
The IPC does not punish suicide itself but punishes attempt and abetment.
These provisions aim to protect life and prevent others from encouraging such acts.
Meaning / Definition
Suicide
- Suicide means intentional self-killing
- It is not defined in IPC but understood as:
- Self-inflicted death
- Intentional ending of one’s own life
Attempt to Suicide (Section 309 IPC)
- When a person:
- Attempts to take their own life, and
- Performs an act towards it
Punishment:
- Simple imprisonment up to 1 year, or
- Fine, or both
Abetment to Suicide (Section 306 IPC)
- When a person:
- Encourages (instigates), or
- Conspires (plans), or
- Intentionally helps

- Incomplete act of suicide

Abetment to Suicide
As per Section 107 IPC, abetment includes:
Instigation
- Encouraging or provoking someone to commit suicide
Conspiracy
- Agreement between persons to make someone commit suicide
Intentional Aid
- Helping by action or omission (failure to act when duty exists)
Presumption in Case of Married Women
- If a woman commits suicide within 7 years of marriage
- And was subjected to cruelty by husband or relatives
Then:
- Court may presume abetment under Evidence Law
- Usually read with Section 498A IPC (cruelty)
