Essentials and Formal Requirements of Wakf

Introduction

For a wakf to be valid, certain legal conditions must be satisfied.
These include the capacity of the person creating the wakf (wakif), the nature of the property, the purpose of dedication, and required formalities.
These rules ensure that the wakf is genuine, lawful, and enforceable.

Meaning / Definition

Essentials of wakf refer to the legal requirements relating to:

  • Who can create a wakf
  • What property can be dedicated
  • For what purpose it can be created
  • How it must be created

These conditions determine the validity of a wakf under Muslim law.

Modes or Types

Capacity to make wakf

  • Only a Muslim can create a wakf
  • Must be:
    • Major (adult)
    • Of sound mind
  • Wakf created by a guardian on behalf of a minor is invalid

Subject matter of wakf

  • Property can be:
    • Immovable (land, building)
    • Movable (animals, books, etc.)
  • Conditions:
    • Property must be tangible (physical)
    • Must be capable of use without being consumed
  • Wakf of musha (undivided property capable of division) is generally not valid

Object of wakf

  • Purpose must be:
    • Religious
    • Pious (morally good)
    • Charitable
  • Applies equally for benefit of rich or poor
  • Main aim is to earn spiritual benefit in the eyes of God

Formalities of wakf

  • Wakf can be created:
    • During lifetime (inter vivos)
    • By will (takes effect after death)
  • If created by will:
    • Valid only up to one-third of property
  • No specific form is required
  • Wakif can appoint himself as first mutawalli (manager)

Registration

  • If property value exceeds ₹100:
    • Registration is compulsory under the Registration Act

Practical Example

A Muslim adult of sound mind:

  • Dedicates his land for a charitable hospital → valid wakf
  • Attempts to create wakf for consumable goods like food → invalid
  • Creates wakf through will for more than one-third property without consent → invalid to that extent
