Family Wakf (Wakf-alal-Aulad)

Introduction

Family wakf (Wakf-alal-Aulad) allows a Muslim to dedicate property for the benefit of family members.
It balances private benefit with public charity by ensuring that the property ultimately serves a religious or charitable purpose.
Its legal validity evolved through judicial decisions and later legislation.

Meaning / Definition

Family wakf is a wakf created primarily for the benefit of the settlor’s (creator’s) family, children, and descendants, with an ultimate benefit reserved for religious, pious, or charitable purposes.

It is a permanent dedication of property where:

  • Immediate benefits go to family members
  • Final benefit must go to charity or religious use

Modes or Types

Private benefit (family-oriented wakf)

  • Property is used for the maintenance and support of:
    • Family members
    • Children
    • Descendants
  • Can continue for an indefinite period

Ultimate charitable benefit

  • The wakf must provide that, after the family line ends or in the long run:
    • The property will be used for religious, pious, or charitable purposes
  • This condition is mandatory for validity

Important Case Law

Abu Fata Mohammed Ishak v. Russomoy Dhur Chowdhury (1894)

  • The Privy Council held that family wakf was invalid
  • Reason: It allowed indefinite benefit to family, which was seen as against public policy (public interest)

Legislative response

  • The Mussalman Wakf Validating Act, 1913 was enacted
  • It declared family wakf as valid, subject to conditions
