Termination of Bailment

Introduction

Termination of bailment means the end of the relationship between the bailor and the bailee. It determines when the rights and duties of both parties come to an end. Understanding termination is important for exams and practical application of bailment law.

Meaning / Definition

Termination of bailment refers to the point at which the contract of bailment comes to an end, and the goods must be returned or dealt with according to the terms agreed between the parties.

Modes or Types

Expiry of fixed period

When goods are bailed for a fixed time, the bailment automatically ends after that time period expires.

Fulfilment of purpose

When goods are bailed for a specific purpose, the bailment ends once that purpose is completed.

Inconsistent use of goods

If the bailee uses the goods in a way that goes against the agreed terms, the bailor has the right to terminate the bailment before time.

Destruction of subject matter

If the goods are destroyed or become unusable for the purpose of bailment, the contract comes to an end.

Termination of gratuitous bailment

A gratuitous bailment (no payment involved) can be terminated by the bailor at any time, even before the agreed period or purpose is completed.
However, if early termination causes loss to the bailee greater than the benefit received, the bailor must compensate (pay for loss) the bailee.

Death of either party

In the case of gratuitous bailment, the death of either the bailor or the bailee leads to termination of the contract (Section 162).

Practical Example

A gives his laptop to B for repair for one week.

  • If one week ends → bailment ends
  • If repair is completed earlier → bailment ends
  • If B misuses the laptop → A can terminate early
  • If the laptop is destroyed in a fire → bailment ends
