Article 300-A

Introduction

Article 300-A marks a major shift in the status of the right to property in India. It was introduced by the 44th Constitutional Amendment, 1978. This provision ensures that property cannot be taken away without legal authority.

Meaning / Definition

Article 300-A states that no person shall be deprived of their property except by authority of law.

This means:

  • Property is no longer a fundamental right
  • It is now a constitutional legal right
  • The State can take property only through a valid law (proper legal process)

Modes or Types

Property as a constitutional legal right

  • The right to property is protected under Article 300-A.
  • It does not have the same strong protection as fundamental rights.
  • It cannot be directly enforced under Article 32 in the Supreme Court.

Requirement of authority of law

  • Property can be taken only if there is a valid law.
  • The action of the State must follow legal procedure.
  • Arbitrary action (unfair or without reason) is not allowed.

Protection of minority rights

  • The removal of property as a fundamental right does not affect:
    • Rights of minorities under Article 30
    • Their right to establish and manage educational institutions

Protection of farmers and landholders

  • Persons holding land for personal cultivation within ceiling limits are protected.
  • They are entitled to receive compensation based on market value when land is acquired.
